In September 2008, a New York judge handed down a decision in favor of author J. K. Rowling and Warner Bros. who own the film rights in the Harry Potter books, in a literary and copyright law case involving a fan website that was planning on publishing a reference book on the Harry Potter saga.
What the ruling determined was that the reference book simply copied too much of the Rowling books to be considered fair use. The fact that what was copied was creative material as opposed to factual material, also hurt the website’s case as creative material enjoys a higher level of protection.
What the ruling does is to reiterate the rule that for a derivative book to enjoy the fair use protection under the law, it must be very transformative. It must create something else. Instead, the judge found that the reference book copied Rowling’s distinctive style and words in excess of what would otherwise be legitimate to create a reference guide.
The ruling does nothing to dilute the right of parody or literary criticism to be protected by the fair use doctrine. Rather, the ruling may elevate the importance of the “market impact” factor in the four part standard used by judges in evaluating fair use.
Those four factors are first, the purpose and character of the use (is the new work transformative into something different - in this case use of material from two companion reference books of Rowling made the website reference book less transformative). While another part of this factor is whether the use is commercial or noncommercial, most uses are for profit. Another part of this factor is whether the infringer acted in good faith or not.
The second factor is the amount and substantiality of the use, i.e. whether the amount of the use by the infringer is reasonable for the transformative purpose. Here, apparently, it was not.
The third factor is the nature of the copyrighted work, creative works being given much greater protection than factual works.
The fourth factor is the harm to the market of the original work by the infringing work. Here the court found that while the website reference book might not harm the market of the Harry Potter novels, it might very well harm the market of Rowling’s companion books.
Consequently, the New York judge issued a permanent injunction against publication of the website reference guide. The decision may be appealed and it is possible if the website reference book were edited, it might pass muster. But in this copyright lawyer’s opinion, the success of an appeal or an edited book to pass muster as being fair use is unlikely under these circumstances and as a result of this ruling infringers in California and the U.S. will now have an even harder time trying to make a profit off of another writer’s work.

No Heaven for Harry

I was wondering where God is in the Harry Potter books. Don’t get me wrong. I’ve read them all and I plan on reading the next one when I can get my hands on it - all seven thousand pages, or whatever monster volume J.K. Rowlings comes out with, because nobody edits her anymore. (I’m not such a huge fan, but I find these books pleasantly diverting enough so that I read each one all the way through).
But as to my question, after reading all of these books I was just struck by the fact that nobody ever goes to church in her books. Even the cruel Aunt and Uncle who care for young Harry in the muggle(non-magical) world never go to church. It seems to me that she Rowlings posits a sort of agnostic or secular type of England where no one much seems to have any sort of spiritual philosophy, outside of perhaps just the existence of magic.
There are ghosts in her books which indicates some sort of after life. They function sort of as a comic relief and they don’t do much of anything except basically hang around and make conversation every now and then. There’s no indication that they ever faced judgement or will or might go either to Heaven or Hell or even what unfinished business they might need to finish on the Earth. Major characters who have died, Harry’s parents, Sirius Black, don’t become ghosts. So, what happens to them?
There’s never any mention of God. There’s also no mention of the Devil. And there’s never any mention of where magic comes from or why there’s even magic in the world. (I know. The evangelical answer is: The Devil. But these are her books and it’s for her to answer). This finally makes her books rather unsatisfying because she lacks a unifying framework to put all of her stories in.
I haven’t dismissed the idea that her books are in themselves metaphors for a Christian theology. In this case, Hogwarts schools would represent the world, the students are us, Lord Voldemort would be the Devil (obviously) and Dumbledore would be God, you know with his long white beard and all-knowingness. Maybe then Harry is Jesus. Well, I’m sure I’m not the first person to come up with this interpetation.
Generally, I don’t think Christian symbolism works too well in fantasy. I’m thinking of C.S. Lewis’s Lion, Witch and Wardrobe books, whichI read when I was eight or nine. I read a few of them and then stopped when I figured out what was going on. The fantasy elements were fun, but the preachiness turned me off. And I got enough of that in church, anyways.

Rome is behind to nobody and all the major bookstores will be open at 08:00 am sharp on the 21st of July for the last chapter of the Harry Potter saga. Book your Rome accommodation and you will spend a very original weekend with the most known wizard in the world.
Feltrinelli International, one of the major bookshops in Rome is located in the Termini area, therefore you could book one of the very many hotels around there. 4 star hotels as well as 2 star guest houses and bed and breakfast to satisfy all kind of wizard and witch. It would be nice to stay in the area since the bookstore is organizing events that will go on for the whole day. At 08:00 breakfast with Potter, at 17:00 Tea Time and at 18:00 reading with Alison Victoria. Not to be missed!!

Circo Massimo could be the ideal location to enjoy a super cool quidditch match besides of course… that is full of history.
After you have purchased your book you could spend a few hours in the Avalon Pub. Wood tables and benches, gloomy atmosphere, gates, armours, it resembles a castle. You could really feel at Hogwarts. Avalon takes its modern name from the celtic Annwyn, or rather the fairy godmother island. Nothing better! Enjoy.
Rome offers nice lodgings and cheap bed and breakfast around the Vatican area for the muggle world, for those who don’t believe in magic and for those who refuse to see its positive aspects; for those who agree with Rev. Harry Potter and the Half Blood Prince is the sixth part of the charismatic Harry Potter series. Now the fans are awaiting the movie’s release on 15th July 2009. It reveals the enemies of Harry, especially Lord Voldemort, their past and their dark and cunning plans. It also unveils more mysteries, creatures, spells and some shocking facts.
In the Hogwarts Express, Harry spied on Draco and overheard him talking about the orders given to him by Voldemort. Harry has since been very suspicious about him. Later in this part, Ron is nearly killed when he drank poisoned mead and Katie Bell nearly died in Hogsmead while handling a cursed necklace. Harry suspected that Draco was behind these attacks. Draco also revealed at the end of the story that he has been setting paths for Death Eaters to enter the castle and carrying out attacks on students.
During his year at Hogwarts, Harry gets hold of a notebook of a former student. Through this book, he is able to improve his scores in potions, learns new tips, and spells as well. During a fight with Draco, he uses one of the lethal spells from the book, which injures Draco very brutally. He was later punished by Snape for doing this. He was also called to regular meetings with Dumbledore where he taught him about Voldemort’s past and his Horcuxes. He told Harry that it was important if he was to tackle the events in his future life.
This book also reveals shocking truth about Snape. When Harry and Dumbledore reach the Astronomy tower after the search of one the Horcuxes of Voldemort, Draco arrives to fulfill Voldemort’s order of killing Dumbledore. However, Draco fails to carry out the orders. Consequently, Snape arrives at the scene and kills Dumbledore. When Harry follows them out of the tower, he tries to attack Snape, but the master was better than his student. There Snape disclosed that he was the Half Blood Prince, son of Muggle father and Pure-Blood mother.
A main character of the movie is Lord Voldemort. He was a dark wizard, who once studied in Hogwarts. His real name was Tom Marvolo Riddle. He was a descendant of Salazar Slytherin, one of the four founders of Hogwarts. He attacked Harry’s parents in their house. However when he attacks Harry, he somehow loses all his powers and the baby Harry remains alive with a scar on his forehead. He now lived in a non-existent form trying to regain his physical form and powers.
In the movies, Voldemort appears in three forms. One is the child Tom Riddle, played by Hero Fiennes-Tiffin. The teenage Tom Riddle is played by Christian Coulson and the scary appearance, which Voldemort currently takes, is played by Ralph Fiennes.
In this part, he has been planning most of the attacks and evil schemes assigned to his followers. For example, he planned Dumbledore’s assassination and gave Draco Malfoy the task. He, however also carried out some murders himself. He killed Amelia Bones of the Magical Law Enforcing Department and a member of the Order of the Phoenix, Emmeline Vance.

I am working on rejoicing today. I read J.K. Rowling’s commencement speech at Harvard. It was a very wonderful message I thought. Her two themes, failure and imagination, made connections in my mind to a movie I watched over the weekend.
I rented “Into the Wild” on Saturday for the second time. It’s the Sean Penn movie about a kid who graduates from college and then disappears on a journey of self-discovery. He takes on the name of Alexander Supertramp and Alex leaves no trace of where he is going and he never communicates with his troubled family again. Alex meets people who seek to connect with him but all along his journey he only seeks to separate himself again and again.
The young man’s journey touches on the theme of failure that Rowling spoke of at Harvard. She experienced failure and overcame it. She encouraged the young graduates to look at failure as a possible outcome of their future endeavors. Her personal triumph lends a golden tint to failure; but she encourages them to see failure as opportunity. Alex checks out of life in response to a prescribed concept of failure; a damning view of failure that labels people as winners and losers. He chose to select failure in rebellion: he selected his own concept of what it meant to be successful.
Rowling echoed that sentiment but went about it in a completely different way. She described coming to the realization that failure had set her free, much as Alex set himself free. Rowling described how her decision to write sprang from failure. She decided that if she were to fail again it was a short fall back to rock bottom. Alex decided that rock bottom was the only place to be. It was where he could be free.
Alex removed himself from everyone, family, friends and acquaintances. He went into the wild of Alaska and lived out his days alone. He discovered too late that relationships are what give meaning to life. He discovered in the wild that loneliness is a trap. I wonder how Alex would speak of failure to the Harvard graduates today. I wonder if he would define failure as adhering to society’s concepts of success or if he would define failure as isolating yourself from love.
Rowling’s second theme was about imagination. She didn’t talk about using imagination to build fictional worlds but rather to experience and empathize with the pain of others, to use those feelings to encourage action to improve the lot of the less fortunate. Alex lacked empathy. He shielded himself from it because of his pain. In every encounter with the characters he met along his journey, he failed to empathize with their pain. He wasn’t uncaring but he maintained a safe distance from all of them and just when it seemed he might become connected, he fled, into the night when he could.
So rejoice in the opportunities of failure and help others to find ways to rejoice as well; especially those who are in need of being uplifted. Alex wrote before he died that “Happiness is only real when it’s shared.” My message today is to rejoice and to find someone to share your happiness with. Trust your failures to teach and not destroy you; and as Rowling did, use rock bottom as your firm foundation for building anew.
